1. Acceptance of Terms
By accessing or using Evalat, you agree to these Terms and Conditions. If you do not agree, do not use the platform.
2. Platform Scope
Evalat is a SaaS platform for online exam creation, delivery, proctoring workflows, and assessment analytics for institutions and students. Features may vary by subscription plan.
3. Account Responsibility
- Users must provide accurate registration data.
- Users are responsible for account credentials and activity under their account.
- Institutions are responsible for teacher/student provisioning within their tenant.
- Users must complete required verification steps (email, phone, OTP/2FA where configured).
4. Acceptable Use
You must not misuse Evalat, attempt unauthorized access, bypass security controls, distribute harmful code, manipulate results fraudulently, or violate applicable law.
5. Exams and Integrity
- Exam runtime may enforce fullscreen mode, timer, and anti-cheat event logging.
- Institutions may enable additional controls such as webcam monitoring where supported by plan.
- Evalat logs suspicious events for integrity and audit purposes.
6. AI-Generated Content
AI-generated questions are assistive and should be reviewed by educators before high-stakes usage. Institutions and teachers are responsible for final exam content quality, compliance, and relevance.
7. Subscription, Billing, and Limits
- Paid features are subject to selected plan limits (exam creation, AI quota, feature access).
- Billing cycles may be monthly or annual as per selected plan.
- Failure to maintain active subscription may result in plan downgrade, feature restrictions, or service interruption according to configured grace policies.
8. Intellectual Property
Evalat platform software, branding, and related assets are proprietary. Users retain ownership over their own academic and institution content uploaded to Evalat, subject to rights needed to operate the service.
9. Availability and Changes
We may update, modify, or discontinue features to improve service quality, security, or compliance. Planned maintenance or emergency updates may affect temporary availability.
10. Disclaimer
Evalat is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation in all circumstances.
11. Limitation of Liability
To the maximum extent permitted by law, Evalat is not liable for indirect, incidental, special, or consequential damages arising from platform use.
12. Termination
We may suspend or terminate access for violation of these Terms, security threats, abuse, non-payment, or legal requirements.
13. Governing Law
These Terms are governed by applicable laws of India, unless otherwise required by contract with an institution or by mandatory local law.
